Last Will & Testament
 
I receive many requests to notarize a Last Will and Testament.  I do so with the understanding that the person requesting the notarization understands that I am a notary -- not an attorney.  Therefore:
 
  • I may not offer any advice.  I cannot tell you how to complete the document, if it is legally sufficient, what to do with it once it is signed, ... etc.

 

  • The Last Will and Testament must contain a notarial certificate (notary wording).  I may not choose what type of certificate to add to a Last Will and Testament.  A notary risks prosecution for the unauthorized practice of law by choosing what type of notarial act to perform.

 

  • If you require witnesses, you must provide the witnesses.  I do not provide witnesses.

 

  • Notarizing a Last Will and Testament does not "legalize" it, or make it "official".  If you need legal advice, you should consult with an attorney.
